By accessing and using Grownalytics ("the Service"), operated by Grownalytics, based in Sweden, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Grownalytics is an affiliate tracking and conversion analytics platform designed for marketers to track real, valuable actions beyond initial signups or clicks. Our service includes:

Click, lead, and conversion tracking and verification systems
Server-side integration with advertising platforms (Meta Conversions API)
Client-side tracking via JavaScript snippet and Meta Pixel
Real-time dashboard and analytics
API keys for custom integrations
Opt-in page builder for lead capture
Workspace-based multi-user management

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate and current
Maintain the security and confidentiality of your login credentials and API keys
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree not to use the Service for any unlawful purposes or in any way that could damage, disable, overburden, or impair the Service. Prohibited activities include:

Fraudulent or deceptive tracking practices
Generating fake conversions or manipulating data
Violating any applicable laws or regulations
Attempting to gain unauthorized access to our systems
Reverse engineering or attempting to extract source code
Using the Service to promote illegal activities or content
Data scraping, extraction, or automated data collection from our platform
Using automated tools to access or interact with our Service without explicit written consent

Data Protection and Anti-Scraping Policy

We strictly prohibit unauthorized access to, extraction of, or scraping of any data from our platform. This includes:

Automated crawling, scraping, or data mining of our website or platform
Unauthorized access to user data, form submissions, or analytics information
Reverse engineering our tracking mechanisms or conversion verification systems
Using our content, data, or intellectual property in external applications without authorization

Legal Enforcement: We actively monitor for unauthorized data access and will pursue legal action against violators. Violations may result in immediate account termination and legal proceedings.

5. Payment Terms and Billing

Use of certain features of the Service requires payment of fees:

Fees are charged in advance on a monthly or annual basis
All fees are non-refundable except as required by law
We reserve the right to change pricing with 30 days' notice
Failure to pay fees may result in service suspension or termination
You are responsible for all taxes related to your use of the Service

6. API Usage and Integration

Follow the terms of service of integrated platforms (Meta, etc.)

7. Affiliate Program Terms

When tracking affiliate conversions through our platform:

You must have proper agreements with your affiliate partners
All tracked conversions must represent genuine, valuable actions
You are responsible for compliance with affiliate network terms
Conversion data is for informational purposes and subject to verification
We are not responsible for affiliate network payment disputes

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Grownalytics and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works
Grownalytics branding and logos may not be used without permission
You retain ownership of your data and content submitted to the Service

9. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

Data Classification and Usage Rights

Platform Data (from Third-Party Integrations)

Data obtained through integrations with advertising platforms (Meta, Facebook, Instagram, etc.):

Usage: Used strictly for conversion tracking, analytics, and campaign optimization as permitted by each platform's terms
Sharing: Not sold, licensed, or transferred to third parties. Shared only as explicitly permitted by platform terms
Deletion: You may request deletion of Platform Data at any time. We will process such requests promptly and in accordance with platform requirements
Retention: Retained only as long as necessary for legitimate business purposes and as required by platform terms

First-Party Data (Directly Collected)

Data collected directly through our website, opt-in forms, tracking snippet, and direct interactions with our platform:

Usage: Service delivery, customer support, analytics, and business operations
Account Data Rights: You may request access to, correction of, or deletion of your personal account information

Third-Party Platform Compliance

When using our integrations with third-party platforms, you acknowledge that:

You must comply with all applicable platform terms and policies (Meta Platform Terms, etc.)
You must obtain proper user consent before tracking or collecting data
We will cooperate with platform data deletion and user rights requests
Platform Data will not be used for prohibited practices as defined by each platform's terms

Data Controller Obligations

By using Grownalytics to create data collection interfaces, implement tracking systems, or collect information from end users through our platform, you act as a data controller under applicable privacy laws. You must:

Obtain clear, informed, and explicit consent from all end users before collecting their data
Inform end users that Grownalytics will process their data as a data processor
Provide links to both your privacy policy and Grownalytics's Privacy Policy
Comply with GDPR, CCPA, and all applicable privacy laws in relevant jurisdictions
Handle data subject requests within legal timeframes

You agree to indemnify and hold Grownalytics harmless from any claims, fines, penalties, or legal actions arising from your failure to obtain proper consent or comply with privacy laws.

10. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" without warranties of any kind
We are not liable for any indirect, incidental, or consequential damages
Our total liability will not exceed the fees paid by you in the 12 months preceding the claim
We are not responsible for third-party services or their availability

11. Termination

Either party may terminate this agreement:

You may cancel your account at any time through your dashboard
We may terminate or suspend your account for violations of these Terms
Upon termination, your right to use the Service will cease immediately
We will provide reasonable notice except in cases of serious violations

Account Deletion

You may permanently delete your account and all associated data at any time from Account Settings → Security → Delete Account. When you do:

All personal data, workspace data, leads, clicks, conversions, integrations, API keys, and team memberships are permanently deleted
Any active subscription is cancelled — no further auto-renewal charges will be made
You retain access until the end of your current billing period (renewal date)
This action is irreversible and cannot be undone

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Sweden.

13. Platform Data Compliance

We are committed to full compliance with all third-party platform terms and policies:

Meta Platform Compliance

We comply with Meta's Platform Terms and Developer Policies, including:

No selling, licensing, or purchasing of Platform Data
Immediate processing of user deletion requests
No use of Platform Data for prohibited practices
Secure handling and storage of Platform Data
Compliance with Platform Data usage restrictions
PII hashing (SHA-256) before transmission via Conversions API
Support for Data Processing Options (LDU compliance)

User Data Deletion Callback

For Meta platform data deletion requests:

Automated processing via deletion callback URL
Confirmation code and status URL provided
Complete data removal within 30 days

14. Data Security and Incident Response

We implement appropriate technical and organizational measures to protect your data:

Platform Data Security

Industry-standard encryption and access controls
Immediate incident reporting to relevant platforms
Regular security audits and compliance monitoring

Incident Response

In case of any security incident affecting Platform Data, we will notify affected platforms and users as soon as practicable and comply with all applicable breach notification requirements.

Legal Basis for Data Processing

Platform Data: Processed based on legitimate interests for conversion tracking and platform compliance, subject to user consent requirements
First-Party Data: Processed based on consent (forms), contract performance (service delivery), and legitimate interests (business operations)
Account Data: Processed based on contract performance and legal obligations

16. Platform Policy Changes

Third-party platforms may change their terms and policies:

We will make commercially reasonable efforts to comply with platform policy changes
Service features may be modified or discontinued due to platform requirements
We are not liable for service interruptions caused by platform policy changes
Users will be notified of material changes affecting service functionality
